Oral hearing in Bitcoin VAT case on June 17th

Background: See my last post about the Bitcoin VAT case in the EU Court of Justice here.

The date has now been set for an oral hearing. It will be held at the EU Court of Justice in Luxembourg on June 17th, 09.30. Two member states, Germany and Estonia, previously submitted written arguments not in favor of VAT exemption and Germany has indicated that they will also participate in the oral hearing.

We have 15 minutes at our disposal and the court wants us to focus on new arguments, not repeating what was stated in the written submissions. The decision could still take several months after this hearing but at least we’re getting closer! (It has been 2 years and 8 months since I submitted my original request for a preliminary ruling in Sweden.)

    I assume you can read Norwegian? Here is a link to my reply to a written hearing in Norway about, among other things, VAT on financial services. My argument is that bitcoin should be in the same way as other currencies. It is not a service, because bitcoin can not be consumed. Bitcoin has no end user, it is only a token which can change owner. It behaves just like a means of payment, i.e. a currency, not as a service which has a consumer at the end.

      Tack Sturle! Ska läsa igenom ordentligt. Jag känner mig ganska trygg med att det inte kommer att bli moms på hela bitcoinbeloppet – fallet handlar främst om huruvida det ska vara moms på växlingsavgifter.
